FAQ – Community Handbook including Architectural Review Guidelines

What is a Community Handbook?

The community handbook is a collection of all the policies and procedures that MIA uses for business and recreational operations. Many of these policies already existed and some are newly required by California State law. The handbook groups all of these policies together in one document. The handbook has been created with an HOA attorney to ensure it meets all state and local requirements.

Why is the MIA Board doing this now? 

California state and local laws require HOAs to establish various operating procedures. MIA previously did not have all the policies and procedures required by law. In addition, many of the existing policies were not in compliance with current laws. An HOA attorney has been consulted to ensure MIA is meeting current obligations.

Is the Board changing the CC&Rs?

The Covenants, Conditions and Restrictions (CC&Rs) are the original rules established when the HOA was first formed back in 1967. The Board cannot modify any of the CC&Rs without a formal vote of the residents. However, some portions of our original CC&Rs have been overwritten by recent state law. There are no plans to modify any of our CC&Rs. The community handbook establishes policies and procedures on how to implement the rules in the CC&Rs.

Why is the Board Establishing an Architectural Review process?

The need for an Architectural Review is mandated per the original HOA CC&Rs established in 1967. Over the years, boards have used different procedures to manage the architectural review process. The community handbook outlines a formal procedure for this CC&R mandated process.

What modifications are subject to an Architectural review?

Any changes to the exterior dwelling structure, or any structures erected on a property are subject to review. These include items such as: building additions, hardscape, fencing, sheds and ADUs. Not included are items such as: any interior changes/remodels, exterior paint, and landscaping.
